Newark foreclosure defense and real estate attorney

Newark is New Jersey's largest city and the seat of Essex County, and its neighborhoods of two- and three-family homes in the North Ward, Ironbound, Vailsburg, and Weequahic have carried some of the state's highest foreclosure rates for more than a decade. David Chapman defends Newark homeowners in the Chancery Division downtown and at the negotiating table with their servicers.

Local knowledge that matters

Contested Newark foreclosures are heard by the Essex County General Equity judges in the courthouse complex on Dr. Martin Luther King Jr. Boulevard, a short walk from the Essex County Sheriff's foreclosure sales on the 14th floor of 60 West Market Street. Sales are held on Tuesdays at 1:30 PM, every other week, with a 20 percent deposit by bank check.

Essex County publishes the strictest adjournment rules in the state: two statutory adjournments of 28 days each at $28, requested by 12:00 noon on the sale date. A Newark homeowner who misses that noon deadline loses the adjournment. David files them days in advance.

Many Newark homes are still titled in a deceased parent's name or shared among siblings. Heirs have the right under federal servicing rules to be evaluated for a modification, and the estate issues can be resolved alongside the foreclosure. Free HUD-approved counseling is available in the city, and the court's mediation program is free for owner-occupants who request it within 60 days of service.
