Union County stretches from the dense, largely immigrant neighborhoods of Elizabeth and Plainfield to the high-equity suburbs of Westfield and Summit, and foreclosure defense looks different at each end. David Chapman represents Union County homeowners in the Chancery Division in Elizabeth and negotiates directly with their lenders.

How foreclosure works in Union County

New Jersey is a judicial foreclosure state, so every Union County foreclosure starts with a lawsuit in the Superior Court. Before filing, the lender must mail a Notice of Intention to Foreclose under the Fair Foreclosure Act (N.J.S.A. 2A:50-56) at least 30 days in advance. Once you are served with the complaint you have 35 days to file an answer. If you do, the case is assigned to a General Equity judge in Elizabeth. If you do not, it is treated as uncontested and processed on paper by the Office of Foreclosure in Trenton, which is why the answer matters so much.

Owner-occupants can request the court’s free Foreclosure Mediation Program within 60 days of service, which pauses the march to judgment while a modification is negotiated with a housing counselor and mediator in the room. After final judgment, a writ goes to the Union County Sheriff, who has 150 days to schedule the sale. Even after the sale, New Jersey provides 10 days to redeem or object.

Contested Union County foreclosures are heard by the General Equity judges at the Union County Courthouse on Broad Street in Elizabeth. Sheriff's sales are unusual here: they are held every other Wednesday afternoon at the Warinanco Ice Skating Center in Roselle rather than at a county building, and the sheriff requires that adjournment requests be made in person by the homeowner. Homeowners who send a relative or mail the form have lost their adjournment.

Elizabeth, Plainfield, Hillside, and Linden have a high share of two- and three-family homes and of homeowners who bought with the help of family co-signers. Those cases turn on documenting rental income and every borrower's finances correctly in the modification application, which is where most do-it-yourself applications fail.

In Westfield, Summit, Cranford, and Berkeley Heights, the equity at stake is often large enough that the lender would rather modify or approve a short sale than risk a contested case. David uses that to negotiate outcomes that protect the equity.

The Union County foreclosure timeline, step by step

  1. Missed payments (days 1–90). Late fees, servicer calls, and credit reporting begin. Under federal rules the servicer must tell you about loss mitigation options by day 45. This is the cheapest moment to fix the problem.
  2. Notice of Intention to Foreclose (day 90+). Required by the Fair Foreclosure Act at least 30 days before suit, sent by certified mail. It states the arrears and your right to cure. A defective notice is a defense.
  3. Complaint filed and served (day 120+). The lender sues in Superior Court. You have 35 days to answer. Answer, and a General Equity judge in Elizabeth hears the case; ignore it, and the Office of Foreclosure processes it on paper.
  4. Mediation window (60 days from service). Owner-occupants can request the free court mediation program, which pauses the case while a modification is negotiated.
  5. Final judgment. Before applying, the lender must send a further 14-day notice giving you a last chance to cure. You can still cure up to the day judgment is entered.
  6. Writ of execution to the Union County Sheriff. The sheriff has 150 days to schedule the sale. Sales here are held on Wednesdays. You are entitled to two adjournments, and the court may grant more for cause.
  7. Sheriff’s sale and the 10-day window. After the sale you have 10 days to redeem by paying the judgment or to object to the sale; the deed is not delivered until that window passes. A bankruptcy filed in the window extends it.

Loan modification and short sale in Union County

Most Union County foreclosures end in a negotiated outcome, not a courtroom verdict. If you want to keep the home and have income going forward, David prepares a complete loan modification package and, where the timing works, pairs it with a mediation request so the servicer must respond in front of a mediator. If keeping the home is not realistic, a short sale approved by the lender, with the remaining balance released in writing, protects your credit and often puts relocation money in your pocket. Because sheriff’s sales in Union County are held on Wednesdays, David calendars every adjournment deadline backward from the sale date so the negotiation has the time it needs.

Ways to stop or resolve a Union County foreclosure

  1. Loan Modification. Lower your rate, extend your term, and make payments affordable again.
  2. Short Sale. Sell for less than you owe and walk away without a foreclosure on your record.
  3. Stop a Foreclosure Sale. Emergency help when a sale or auction date is already scheduled.
  4. Deed in Lieu of Foreclosure. Hand the property back by agreement, on better terms than a foreclosure.
  5. Foreclosure Litigation. Challenge improper filings, defective notices, and servicer violations in court.
  6. Surplus Funds Recovery. If your home sold at sheriff's sale for more than you owed, the difference may belong to you.
  7. Mediation. The free court program that puts your modification in front of the lender with a mediator present. How it works.
  8. Bankruptcy, by referral. A bankruptcy filing imposes an automatic stay that halts a sale. David does not handle bankruptcy cases. When a bankruptcy filing is the right tool, he refers you to a bankruptcy attorney.

Defenses that work in Union County cases

Every file is different, but the defenses David raises most often include a defective or missing Notice of Intention to Foreclose, a plaintiff that cannot prove it holds the note and mortgage, dual tracking in violation of federal servicing rules (12 C.F.R. 1024.41), misapplied payments and improper fees that inflated the default, and failure to send the 14-day notice required before final judgment. Raising the right defense at the right time is what turns a foreclosure into a negotiation.
