What a loan modification can change
Servicers have several levers, and the best result usually combines more than one:
- Lower the interest rate, sometimes for a fixed period and sometimes permanently
- Extend the term (for example, to 40 years) to reduce the monthly payment
- Capitalize the missed payments into the balance so you are no longer in default
- Defer or, in limited programs, forgive a portion of the principal
Why applications get denied
Most modification denials have nothing to do with whether you qualify. They come from incomplete packages, missing signatures, stale pay stubs, or documents the servicer claims it never received. Each round trip can take 30 days, and the sale date does not wait.
David assembles a complete application the first time, tracks every submission, and escalates when the servicer stalls. If the servicer violates loss mitigation rules while your application is under review, that can also be grounds to halt a sale.
Who qualifies
Generally you need a documented hardship, a stable income going forward, and a payment the servicer's guidelines can support. You do not need perfect credit, and you do not need to be current. Many homeowners who were told they were denied simply had the wrong package submitted.
Loan modifications in New Jersey
New Jersey homeowners have a tool most states lack: the court's Foreclosure Mediation Program. Requested within 60 days of service of the complaint, it puts your modification application in front of the lender in a supervised setting with a housing counselor and a mediator, which makes it much harder for the servicer to "lose" documents or stall. Under the Fair Foreclosure Act you also keep the right to cure the default right up to final judgment. David uses both to keep the pressure on the servicer while your application is reviewed.
