Tools that can postpone or stop a New Jersey sheriff's sale
Which tools apply depends on your loan, your servicer, and how close the date is:
- Statutory adjournments: New Jersey law gives the homeowner two adjournments of the sheriff's sale of up to 30 days each, and the court can grant more for cause
- A complete loss mitigation application, which can trigger federal protections against dual tracking
- Reinstatement or cure: under the Fair Foreclosure Act you may cure the default up to final judgment, and redeem within 10 days after the sale
- A negotiated postponement to allow a short sale or modification to close
- A motion to vacate the judgment or object to the sale where notice, service, or standing were defective
- A bankruptcy filing, which imposes an automatic stay and extends the redemption window. David does not handle bankruptcy cases and refers clients to a bankruptcy attorney when this is the right move
What to do today
Gather your most recent mortgage statement, every notice you have received, and proof of income. Do not sign anything from a company promising to "save your home" for an upfront fee. Then call. David can usually tell you in the first conversation whether the date can be moved and how.
Foreclosure rescue scams
Homeowners with public sale dates are targeted by companies that charge upfront fees for modification help or ask you to sign over the deed. Both are red flags. A licensed attorney is accountable to the state bar and can actually file in court on your behalf.
