Summit foreclosure defense and real estate attorney

David Chapman represents homeowners in Summit and the surrounding towns of Westfield, Cranford, New Providence, Berkeley Heights, and Chatham. Home values here are among the highest in the state, which means a homeowner in default usually has real equity to protect and more leverage with the lender than they realize.

Local knowledge that matters

Summit foreclosures are filed in the Superior Court and, if contested, heard at the Union County Courthouse, 2 Broad Street, Elizabeth, where the General Equity office can be reached at (908) 787-1650 ext. 22140. The Union County Sheriff holds sales every other Wednesday at 2:00 PM at the Warinanco Ice Skating Center in Roselle, not at a county building, with a 20 percent deposit and no more than $500 in cash.

Union County requires the homeowner to appear in person to request a sheriff's sale adjournment and does not take requests between noon and 3:00 PM on Wednesdays. Two 28-day adjournments are available at $28 each. With a high-value home, those 56 days are often enough to close a short sale that preserves most of the equity, or to complete a modification.

Defaults in Summit and the surrounding towns are usually triggered by a job loss, a business downturn, or a divorce rather than by an unaffordable loan. A well-secured loan is one the lender would rather modify than foreclose, and a negotiated short sale or deed in lieu with the deficiency released in writing is almost always better than a sheriff's sale.
