Foreclosure Defense in Toms River
Stop or delay foreclosure through loan modification, short sales, and direct negotiation with your lender, in every New Jersey county.
Learn moreToms River is the seat of Ocean County and one of the ten largest municipalities in New Jersey, stretching from the mainland neighborhoods of Silverton and East Dover across Barnegat Bay to Ortley Beach and Normandy Beach on the barrier island. Superstorm Sandy damaged thousands of homes here, and some owners are still paying for the rebuilding. David Chapman represents Toms River homeowners in the Chancery Division on Hooper Avenue and with their lenders.
Both the courthouse and the sheriff's sale are in downtown Toms River. Contested cases are heard at the Ocean County Courthouse, 100 Hooper Avenue, where the General Equity office can be reached at (732) 504-0700 ext. 64380. Sales are held on Tuesdays at 2:00 PM, except legal holidays, in Room 119 of the County Administration Building at 101 Hooper Avenue, with a 20 percent deposit and certified checks no more than 90 days old.
The homeowner may take two adjournments of up to 30 days each, and the Ocean County Sheriff accepts them up to 2:00 PM on the day of sale. The Foreclosure Unit is at (732) 929-2044. David files adjournments well ahead of that cutoff and uses the time to finish a modification or a sale.
Rebuilding loans, elevation costs, and insurance shortfalls left over from Sandy are documented hardships in a modification application. In the adult communities of neighboring Berkeley and Manchester, a buyer at sheriff's sale must certify age-compliant occupancy before the deed can be recorded, which narrows the bidder pool. The court's mediation program is free for owner-occupants who request it within 60 days of service, but a second home at the beach does not qualify for it.
